Official Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN THE CONTEST (“CONTEST”). Entry into this Contest constitutes your acceptance of these Official Rules.

CONTEST ENTRY DATES: The Contest Entry Period begins on Monday, Nov. 24, 2014 and ends on Friday, March 6, 2015. Entries that are e-mailed or postmarked after the Contest Entry Period will not be accepted. No entries will be returned.

WHO MAY ENTER: Contest is open only to legal U.S. residents who are educators, support professionals, students, or parents of students and working in conjunction with a K-12 U.S. public school.

MULTIPLE ENTRIES: Individuals may submit up to 5 entries.

CONTEST OBJECTIVES: To produce an original photograph, video, or narrative that identifies and develops a success story about healthy competitive food practices to provide educators with ideas to support wellness. To illuminate challenges encountered in implementing Smart Snacks and share how those challenges are addressed.

CONTEST ENTRY: To enter, submit a completed Contest Entry Agreement and Release, along with an original photograph, video (of not more than 2 minutes), or narrative (of not more than 300 words).  A Release must be completed for each participant and/or individual whose image is clearly identifiable in the submission or who contributed creatively to the submission. Minors must obtain parental/guardian signature on their Release.

All entries must be received within the Contest Entry Period.

All entries must be the original work of the participants, may not have been previously published, may not have won previous awards, must not infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property, or other rights of any person, and must not violate any law. NEA-HIN reserves the right to disqualify any entry for any reason, in its sole and absolute discretion.
Odds of winning depend upon number of entries received.

JUDGING: All entries will be judged based on the judges’ determination of the compelling nature of the submission, the prospect of turning the submission into a promotable success story or addressed challenge, and the willingness of the participant’s school to cooperate in the creation of their shareable story. The entries will be divided into three categories (photo, video, and narrative), and top scoring entry in each category will be declared the Category Winner. There will be runners up in each category.

In event of a tie, the winner will be determined based on the judges’ discretion. Judges’ decisions are final and binding.

WINNER NOTIFICATION: Winner(s) will be determined after the Contest’s end date and will be notified by email. At the discretion of the NEA-HIN, Winner may be disqualified for any of the following reasons: if charged with or convicted of a felony or misdemeanor, or is not eligible based on the eligibility requirements set forth above. In the event it is determined that the Winner has not complied with these Official Rules, has failed to execute and return any required documents within the specified time period, has made false statements or a prize notification is returned as undeliverable, then the Winner will be disqualified and at NEA-HIN sole discretion, the Entry with the next highest score may then be declared the alternate Winner.

PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): Prizes for the Winners consist of grocery gift cards of $100-$300 value to be used for a nutrition event at Winner’s school, as well as the creation of a short video documenting the Winners’ success and. Winner is solely responsible for all expenses, costs or fees associated with transportation and acceptance and/or use of the prize not specified herein as being awarded, including without limitation, any and all taxes (if any). Winner is not a recipient of a prize until s/he has been verified as the Winner by NEA-HIN. Upon fulfilling prize, NEA-HIN will be deemed to have awarded the prize to the Winner and such Winner assumes full responsibility for the prize. All prize details are at NEA-HIN’s sole discretion.

GENERAL CONDITIONS: Winning constitutes permission (except where prohibited by law) on the part of NEA-NIH, NEA, and NEA to use Winner’s name, images, hometown, likeness, prize won, and photograph (all at NEA-NIH’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission.

NEA-NIH and their respective officers, directors, agents, representatives, and employees (collectively, “Released Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed Entries; all of which will be void. Released Parties are also not responsible for problems related to technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any entry to be received on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled, or misdirected communications which may limit a participant’s ability to participate in this Contest. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions with may occur in connection with the administration of the Contest, the processing or judging of Entries, the announcement of the prize or in any Contest-related materials. NEA-NIH reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest and, if terminated, at NEA-NIH’s discretion, determine the Winner using all non-suspect, eligible entries received up to time of cancellation using the judging procedure outlined above.

RELEASE  OF RIGHTS: By completing the Contest Entry Agreement and Release, participant grants a perpetual, irrevocable, and royalty-free license to NEA-HIN, NEA, NEA’s affiliates, and other NEA-approved organizations (collectively “NEA Affiliates”) to use the entry and all other materials of every kind whatsoever created by the participant relating to the Contest (collectively, the “Work”). This license extends to use of the Work for all purposes, in any and all media, whether now known or hereafter devised.

MISCELLANEOUS CONDITIONS: Failure to comply with these Official Rules may result in disqualification from the Contest. NEA-NIH reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. Contest subject to all federal, state and local laws and regulations. Void where prohibited by law.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest, Participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action lawsuit, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and participant (or, if an eligible minor, his/her parent or legal guardian) further waives all rights to have damages multiplied or increased.

WINNERS LIST: Winner(s) will be announced in a website posting.
