Should schools be responsible for off campus bullying?
According to the Department of Education, it is the duty of a school to intervene in any situation that they believe to involve harassment or bullying, “a school is responsible for addressing harassment incidents about which it knows or reasonably should have known.”
The Department of Education recently published their “Analysis of State Bullying Laws and Policies” in December 2011. This document details the policies that have been put in place to prevent bullying and harassment and outlines the requirements of each state.
Of all 50 states, only two (Maryland and New Jersey) meet all 16 key components provided by the Department of Education. Four states were excluded because they have no state law requirements (Hawaii, Michigan, Montana and South Dakota).
